I couldn't see the original picture... =( Sorry. So my comment will have to be based as if this artwork was the original rather than... Painted after the picture.

It's an interesting idea, having the foal of a unicorn be brown and hornless. He's a little thin though, isn't he?

The colours are amazingly done and the horn looks beautiful.

You in no way shape or form had permission to rip this, let alone sell it. How on earth do you justify making money from someone else's work without permission? You did a very nice job, but you owe me money for the sales from your theft. By "speedpainting", it's 100% able to be overlaid on my original with no deviation except for the horn and background.

And you won a contest with it. And DD. Congratulations. All 933 who favorited it ought to know that the realism of the horse and baby for which you took credit are NOT yours. You weren't there at 5:30 am as this baby took his first steps, with a camera in your hands.

And yes I bought a copy of it--to use in prosecution. Such a shame. You're very talented with Photoshop. How would you like it if your work was ripped? And profited from? Your deviation would make a nice gift card, etc.--please do try to explain to me how it would be wrong for me to take the print that I bought, scan it and market it for Tshirts and any other thing? I look forward to your response.

The photography thing is somewhat different than the art thing in that I sell "stock photos" of my images for commercial (not just personal) use. And sometimes they're sold with the proviso that the buyer gets exclusive use. If they see that image used elsewhere, it can be rather...sensitive. Same with fine art editioning that I hope to do some day. One gal here took one of my candidate images, square cropped it and called it hers, with a copyright notice--that would make a collector berserk.

I read the comments, and so many of them completely missed any reference to the original image--they saw the whole scene as being of your imagining. People with your skills have the advantage over us photographers--we either have to set the scene and encourage the action, or through skill and timing just capture what the horses offer us.

My thought is that we could probably work together on some images to both of our benefits.

Please do change the description on your deviation to make it much clearer that it's not completely of your imagining, and stop the print sale for now. Can we talk in e-mail instead of here?

ok, so for first I was tempted to hide that comment and answer you with notes, but you're right,so No need to hide that.
I'll answer something here too, because even if I'm wrong on a looots of points, I want to justify me a little.
As I say on the note and on my journal, I was looking for a good ref of a mare and her foal for the Unicorn Club Contest.And when I can't find the kind of pictures I want in my "files library" I ask to my msn friend, who loved horses and drawing, and usually kept lot of pictures in their computer, just as me.
And my friend send me that picture, with your name and link to your website.
I thought the photography was wonderful so I decided to copy out (I hope it's the right word..I mean drawing using the photo as a model).
I was really proud of that drawing, If I remember I think I've spent lots of hours on it...So, I confess that I hadn't been really careful about copyright...I know I had hadn't settle for "my friend send me it so it's good".
So I submit the picture and write a link to your website and the picture, to make everyone know that I havn't invented that scene, nd that I was not the photographer.
I trully thought all was ok!

But I admit that I mustn't put it as a print.But of course I can send you all the print profit!

I know the photography is 60% (maybe more) what it makes that picture good.But I've work on it, and never hide that I've copy out from one of your photography, so I don't think the DD or Faves are thieves.People give me that honours perfectly knowing that YOU are the photographer, and how the original photography look.So I think my ability to paint is not something we can contest.

I can imagine how you can feel and I'm really sorry for that..When I've submitted the picture, I hadn't thought about how it can be annoying to see your own horses as a painting subject.I'm really sorry for that.And if you want I'll delete the deviation.

My work have been thieved a lot of time and it's always irritating, but each time I see it, people are like "I've painted that".And that's false.
But here, I've NEVER said "I photographied that" or "I've imagined that".
I show the original photography and your website.
But I've never had had to put it as a print, and I have had to ask you the permission..That's true....Sorry, I'm truly sorry.

If you want to use it, in every way you want, of course you can.The drawing is yours.
